Noxious gas emitted from several of the State of Tennessee’s Copper Company (defendant) smelting plants near the border of Tennessee and Georgia (plaintiff) caused harm to the State of Georgia’s lands, forests, and crops. Georgia filed suit in the U.S. Supreme Court against the Tennessee seeking injunctive relief to stop the public nuisance.
